Anti-Kickback Statute

The Anti-Kickback Statute prohibits the exchange (or offer to exchange), of anything of value, in an effort to induce (or reward) the referral of federal health care program business.

Prohibited kickbacks include:

  • Cash for referrals
  • Free or below market rent for medical offices
  • Free clerical staff
  • Excessive or non-documented compensation for medical directorships
  • Inappropriate loyalty to a drug or device company

Kickbacks can lead to:

  • overutilization of items or services
  • increased program costs
  • corruption of medical decision making
  • patient steering
  • unfair competition
